In approximately 2 hours, Briddge Legal & Finance will provide the practical seminar Managing underperformance in the Netherlands: Practical guidance for Japanese businesses, offering actionable tools and culturally informed advice tailored to the needs of Japanese employers.
Managing underperformance in the Netherlands requires a careful and structured approach. Unlike in Japan, Dutch employment law regulates unilateral employer action and, among other things, requires employers to actively support employees through improvement processes before dismissal can be considered. Failure to do so may result in legal risks and financial exposure.
In practice, performance issues are often addressed too late or handled in ways that unintentionally escalate tensions – particularly in Japanese companies operating in a Dutch context, where differences in communication style, feedback culture, and workplace expectations can create additional challenges.
This session focuses on what to do – and what to avoid – when dealing with underperformance, combining legal insights with practical guidance on communication, soft skills, and cultural considerations.
